The Council of the city of Ottawa enacts as follows: DEFINITIONS

1. On this by-regulation:

electric kick-scooter” means a vehicle that has,

1. two wheels positioned along the same longitudinal axis, one placed at the front of the kick-scooter and one at the rear,

2. a platform for standing between the 2 wheels,

3. a steering handlebar that acts directly on the steerable wheel, and

4. an electric motor not exceeding 500 watts that gives a maximum pace of 24 kilometres per hour;

“electric kick-scooter parking facilities” embody ring and publish racks, ring racks, charging stations, corrals that assist electric kick-scooters in an upright position or allow the frame to be secured, or an area designated by pavement marking or official signal for parking of electric kick-scooters, and which services are predominantly positioned within town proper-of-method or within a municipal parking lot and may be located in choose designated and delineated on-avenue parking areas or sidewalks, but don’t embody mild standards, utility poles, sign posts, fences, street furniture, or comparable infrastructure within town proper-of-approach;

“pedestrian” means,

1. an individual on foot;

2. a person in a wheelchair; or

3. a toddler in a carriage, stroller or play automobile;

“reserved bicycle lane” means these elements of the highway put aside by the town for the usage of cyclists and designated by official signal or pavement markings;

“roadway” implies that part of the freeway that’s improved, designed or ordinarily used for vehicular visitors, but does not embody the shoulder, and, the place a highway includes two or more separate roadways, the time period “roadway” refers to anyone roadway individually and not to all the roadways collectively;

BY-Law Subject TO THE Highway Traffic ACT

3. The provisions of this by-regulation are topic to the provisions of the Highway Traffic Act.

4. No person shall function, or trigger to be operated, or use an electric kick- scooter on a highway, sidewalk, path, path or walkway, a park, exhibition ground or multi- use pathway trails, unless:

a. permitted by and in accordance with the provisions of the Highway Traffic Act and Ontario Regulation 389/19, as amended;

b. City of Ottawa Traffic. Parking By-regulation No. 2017-301, as amended, pertaining to autos; and

c. permitted by and in accordance with the provisions of this by-law.

5. No person shall function, or cause to be operated, or use an electric kick scooter on a highway with a legal speed limit better than 50 kilometers per hour, unless within a reserved bicycle lane.

6. No person shall operate, or trigger to be operated, or use an electric kick- scooter on a sidewalk, except permitted by official signal.

7. No individual shall operate, or cause to be operated, or use an electric Kick- scooter in a park, or part thereof, the place cycling, skateboarding or rollerblading is prohibited

8. No particular person shall function, or trigger to be operated, use, park or stop an electric balance scooter kick-scooter on or alongside a pedestrian mall designated pursuant to the Traffic and Parking By-law No. 2017-301, as amended.

General Regulations

9. Where a reserved bicycle lane is offered on a freeway, no particular person shall fail to operate an electric kick-scooter within the reserved bicycle lane.

10. No individual underneath the age of sixteen years shall function an electric kick-scooter.

11. No individual underneath the age of 18 years old shall fail to put on a helmet that complies with the Highway Traffic Act when operating an electric kick-scooter.

12. No individual working an electric kick-scooter shall carry another individual thereon.

13. No person working an electric kick-scooter shall tow one other particular person, car or machine.

14. No particular person operating an electric skateboard kick-scooter shall attach himself or herself to a different electric kick-scooter, vehicle or system for the aim of being drawn or towed.

15. No individual operating an electric kick-scooter shall function it in any position other than while standing at all times.

16. No person working an electric kick-scooter shall carry cargo on an electric kick-scooter.

17. No individual shall park or cease an electric kick-scooter or permit an electric kick-scooter to stay parked or stopped on a freeway, roadway, sidewalk or path, path, walkway, park, exhibition floor or multi-use pathway trail, besides where electric kick- scooter parking services are provided.

18. No person shall park or stop an electric kick-scooter or permit an electric kick-scooter to remain parked or stopped within a furnishings zone, until authorized by the city.

19. No individual shall park or cease an electric kick-scooter or permit an electric kick-scooter to stay parked or stopped on a highway, roadway, sidewalk or path, path, walkway, park, exhibition floor or multi-use pathway path in such a manner that obstructs the move of pedestrian, vehicular or cyclist traffic.

Safe OPERATION

20. The operator of an electric kick-scooter shall keep a secure distance from pedestrians and other users of the roadway, shoulder, sidewalk, path, path, walkway, park, exhibition floor or multi-use pathway trail at all times and shall give strategy to a pedestrian or bicycle by slowing or stopping, as mandatory, where there may be insufficient area for the pedestrian or bicycle and the electric kick-scooter to pass.

21. The operator of an electric kick-scooter shall not drive on a trail, or in a park, exhibition floor or multi-use pathway trail at a velocity that is markedly better than the velocity of the pedestrians who are proximate to the electric kick-scooter.

22. The operator of an electric kick-scooter shall ensure the electric kick-scooter is geared up with a bell or horn which shall be kept in good working order and sounded every time it’s moderately necessary to notify cyclists, pedestrians or others of its approach.

23. When operated at any time from one-half hour earlier than sunset to one-half hour after sunrise and at another time when, on account of insufficient mild or unfavourable atmospheric circumstances, persons and autos are not clearly discernible at a distance of 150 metres or much less, every operator of an electric kick-scooter shall carry a lighted lamp displaying a white or amber light on the entrance and a lighted lamp displaying a red light at the rear. The lamps could also be hooked up to the electric kick-scooter or could also be carried or worn by the operator on his or her particular person.

24. No person shall function or use an electric kick-scooter in such a manner that it might hurt, injure or harm, either instantly or indirectly, any individual or property.

Signs BY CHIEF OF POLICE

25. The Chief of Police might erect, place and maintain such official and authorized indicators as are required to provide effect to the provisions of this by-legislation.

OFFENCES AND PENALTIES

26. Every one that contravenes any of the provisions of this by-regulation is responsible of an offence.

27. Every person who’s convicted of an offence under this by-legislation is liable to

1) a minimal high-quality not exceeding $500 and a maximum advantageous not exceeding $100,000 as offered for in subsection 429(3), paragraph 1 of the Municipal Act, 2001, S.O. 2001, c.25, as amended.

2) a special advantageous that may exceed $100,000 as offered for in subsection 429(3), paragraph 1 of the Municipal Act, 2001.

30. This by-legislation shall come into force and take effect on June 29, 2020 and shall be repealed on November 27, 2024.

Short TITLE

31. This by-legislation shall be referred to because the “Electric Kick-Scooter By-law”.
